Florida’s luxury market runs on international money, and a cross-border purchase carries a handful of mechanical obligations a domestic buyer never sees. None are obstacles; all are better handled deliberately than discovered late.

FIRPTA shapes the seller’s side — and your closing

The Foreign Investment in Real Property Tax Act applies when the seller is a foreign person: the buyer becomes responsible for a withholding on the gross sale price, remitted to the IRS, with the exact application and rate depending on how the seller’s status is documented. In practice this means the closing includes a FIRPTA determination — affidavits, withholding certificates where the seller applies for a reduced amount, and a settlement agent who knows the choreography. Buyers are not the taxpayer, but they are the mechanism, so the file must be right.

Currency is a strategy, not a background detail

A purchase funded from another currency moves with the exchange rate between commitment and closing. Buyers manage this in different ways — converting early and holding dollars, negotiating shorter closes, or working with their bank’s foreign-exchange desk on timing. What matters is that the exposure is recognised as a decision: an unhedged, unhurried close is a position, whether or not it was chosen deliberately.

Structuring: the entity conversation

How an international buyer takes title — personally, through a US entity, through a foreign entity, in trust — changes the tax treatment on income during ownership and on a later sale. These are consequential, fact-specific choices, and they must be made with cross-border tax counsel before the offer, because retrofitting structure after closing is expensive and sometimes impossible. The real estate advisor’s role is to slow the transaction down enough for that work to happen.
